At present if a registration of birth of a child or death of a person is delayed by more than one year a miscellaneous case is to be filed before the concerned jurisdictional magistrate arraying the concerned registrar of birth and deaths as a party. When such a case is filed the same will mostly be get settled by compromise in Lok Adalaths or either uncontested by the opposite party i.e. the concerned Registrar of Births and Deaths. Once the order is passed by the concerned jurisdictional magistrate, the registrar of Births and Death will have to register the same without questioning the validity of such order. Hence there is no scope for officials to verify the particulars of the contents of the application made by the applicant.
Further the present practice and legal provision puts heavy financial burden on poor and illiterate persons by making them to avail the services of an advocate. Hence even in the sub urban place to get the birth or death of a person a needy person has to spend more than Rs. 1,500/-. But this system can be changed by making proper amendments leading to the vesting of authority to register the births and deaths upon the Births and Death Registrars after due enquiry and investigation. As most of the elected representatives are engaged in achieving their own financial prospects the civil society should bring pressure on the parliament to effect necessary changes to the said Act.
